Tech Mahindra faces legal trouble over resignation letter

The controversy unfolds

V Balakrishna joined Tech Mahindra on November 9, 2023. However, his tenure was abruptly terminated on February 23, 2024, when he was informed that his services were no longer required. Despite leaving the company as directed, Balakrishna’s resignation letter was never sent. His official termination date was fixed as February 28, 2024, but the company failed to provide the necessary documentation.

Under the Central Industrial Employment (Standing Orders) Act, 1946, a letter of resignation is a legal right for employees who resign or are laid off. Since Balakrishna did not receive this letter, he filed a complaint with the Joint Commissioner of Labour, Ranga Reddy district on April 8, 2024. After numerous meetings and receiving only a partial salary, Balakrishna decided to escalate the matter legally.

In his legal notice to Tech Mahindra, Balakrishna demanded:

  • Issuance of the letter of resignation
  • Full payment of his outstanding salary
  • Compensation of ₹25,000 for legal expenses and mental distress
  • Correction of company policy regarding paid leaves and notice periods to bring it in line with the laws of the State of Telangana

The notice gave Tech Mahindra time until August 2, 2024, to address these claims.
